Sealing Records

Juvenile records can be sealed in most situations. However, if you are charged as an adult before your juvenile records are sealed, they may be used against you in your adult case. If you are convicted, you can lose your right to seal your juvenile records forever. Do NOT wait….Once you are an adult, you should move to seal your juvenile records as soon as you can.

Expunging Records

If you are charged with an offense, but not convicted, you may be able to have all records relating to the arrest ‘expunged’ or deleted. You generally can NOT expunge records involving deferred adjudication, except for most Class C Misdemeanors.

Non-disclosures

Expunctions are not available after completing "deferred adjudication" probation. However non-disclosure orders offer the opportunity to have your record sealed from public view.  This is different from an expunction, as the records are not erased, they are just not released to the public. Therefore, they could come up in the future if the person is prosecuted for another offense. Unlike with expunctions, non-disclosures do not completely erase criminal records, but instead will leave them intact for government purposes.  Most commonly it can be used if the person is ever prosecuted for a crime sometime in the future.
